The FMLA, ADA and Worker’s Compensation laws are so complicated and riddled with problems that they are often referred to, collectively, as the Bermuda Triangle of Employment Law. This is a frightening thought for the HR professional, as the Bermuda Triangle is an area in the Atlantic Ocean where an unusually large number of ships and planes have disappeared without a trace. To avoid this nightmare, it is imperative that all HR professionals understand how these laws are intertwined and this presentation provides a survival crash course for that very purpose.

In this session, Alisa Cleek and Ann Schildhammer will address best practices for handling accommodations for work restrictions and reducing the risks of lawsuits for discrimination and retaliation claims under workers’ compensation, FMLA, and/or the ADA. Focusing on the key requirements of each law, this presentation will enable you to better understand the employer’s responsibilities associated with requests for accommodation and various ways an employer can lawfully and effectively respond to leave requests while curbing leave abuse. Having litigated employment cases and counseled businesses for 30 years, Alisa and Ann will approach these topics from a legal perspective while weighing legal risk against the critical business needs and goals of your organization.
