This session builds upon the topics discussed in Immigration 101, with business immigration attorneys from Ogletree Deakins discussing advanced compliance issues that arise in the context of hiring and retaining foreign workers. During this presentation, HR Practitioners will learn how the government’s increased scrutiny on H-1B petitions has changed the way in which petitions are now filed and adjudicated and what this means for both employers and their foreign workers. The employer-sponsored green card process will be discussed in greater detail, with a focus on common pitfalls that arise during the first step – the PERM labor certification application– and how these can hinder a foreign worker’s ability to remain work authorized long term. Finally, attorneys will share best practices for HR practitioners who encounter site visits and/or audits from various governmental agencies in the areas of I-9 and immigration compliance.
